Within the scope of its activities Mediagenix NV, a limited liability company existing under Belgian Laws, with registered address at Nieuwe Gentsesteenweg 21/1, 1702 Groot-Bijgaarden, registered under enterprise number (0479.295.311) and its affiliates worldwide that link to this Privacy Policy (“Mediagenix”) collect and use information about natural persons (also known as “personal data ”).

Mediagenix processes your personal data in compliance with the applicable legislation on personal data protection (including the General Data Protection Regulation or “GDPR”).

This Privacy Policy sets out how Mediagenix processes your personal data when you use the Mediagenix website, use our Mediagenix Software Solutions and Services, or in any other way interact with Mediagenix. Supplemental transparency may be provided, through e.g. disclaimers, electronic means or orally.

Mediagenix is committed to ensuring that your privacy is fully protected. We might request you to provide certain information by which you can be identified, this information can be Personal data freely provided, for example when registering for newsletters or sending your CV or mandatory personal data when using our Software Solutions or Services. We might also collect automatically certain Usage Data when using the Mediagenix Website or the Software Solutions. Within the scope of our commitment to protect your privacy and the security of your personal data, we wish to explain in all transparency:

2. The controller/processor of your personal data

In some cases, Mediagenix might act as the controller of your personal data. This means that it will decide why and how your personal data will be collected and used. Mediagenix may process personal data in its capacity as operator of the website you visit (for visitors of Mediagenix website), or as otherwise provided in this policy.

In some cases, Mediagenix might act as a processor meaning that it simply processes personal data on behalf of another controller. E.g. in its capacity as company with which you or your employer has developed a contractual relationship with (for representatives/contacts of our prospects, customers and suppliers who are natural persons).

If your personal data is processed by Mediagenix as a processor on behalf of such other controller, please refer to the Privacy Policy of that controller for more information on the personal data processed by Mediagenix (as a processor). 3. Which personal data is processed and how are they collected?

We may process different categories of Personal data in connection with the use of our Website, our Software solutions or our Services. This includes identification and contact data, such as your first name, last name, email address and city; professional data, such as your company name and job function; and connection or technical data, including your IP address, device and browser type, web pages visited, features used, pages viewed, frequency of actions or error events, and your cookie preferences. We may also process any other information you choose to voluntarily provide, for example details included in your communications with us or links to professional profiles such as LinkedIn.

  • You provide some of it directly (such as by subscribing to our Services, signing up for trial use of our Services, through contact forms that you complete, contests that you participate in or upon payment transactions). When you use our Services, we collect information from you in several ways;
  • To request information, quotes or to book a demo, you might fill in the contact form in the Mediagenix Website, providing us with the following information: first name, last name company name, business email and job function;
  • To register and manage your user account to access our Software Solutions and Services, as well as to our demo environment, you have provided us with the following information:
    • your first name, last name, business email address and username;
    • a password, if your organization uses Mediagenix ID for authentication (i.e., your organization does not have a central authentication service integrated in the Services. Following security best practices, we only store an encrypted hash of this password;
    • Optionally an avatar picture and some user preferences (e.g. your preferred time zone and language);
    • We may also collect information about how you interact with our Software Solutions, such as features used, pages viewed and frequency of actions or error events. We use this information in an aggregated form to understand Software Solutions usage and improve our Software Solutions and Services;
    • Your IP address(es), your device and browser type, the web page you visited before coming to our sites, what pages on our sites you visit and for how long and identifiers associated with your devices.
  • When you send your resume for recruitment purposes, or submit an spontaneous application via the Mediagenix Website, we collect the information contained on it, e.g. full name, email address, phone number, picture, cover letter,  country, résumé, LinkedIn profile, which job you have applied for, statuses, notes and planning related to your job application and Email communication;
  • To maintain your marketing preferences and the emails and other communications that you send us or otherwise contribute to, such as customer support inquiries;
  • We might also process your image, photos, video footage or recordings in which you appear, where relevant, for marketing, promotional or communication purposes, such as in connection with events, testimonials, webinars, case studies, social media posts or other Mediagenix promotional materials;
  • You might also provide us with information in other ways, including by responding to surveys, submitting a form or participating in contests, events or similar promotions;
  • Sometimes we require you to provide us with information for contractual or legal reasons;
  • We record some of it automatically when you use our Services, Website or social media pages and thereto linked technologies:
    • We collect information about your activity on and interaction with the Services such as your IP address(es), your device and browser type, the web page you visited before coming to our sites, what pages on our sites you visit and for how long and identifiers associated with your devices.   • We may receive some personal data from third parties:
    • We may receive your personal data directly from your employer or the company you otherwise are engaged with or by, please refer to their Privacy Policy for more information;
    • We may receive your personal data from our partners, agents, resellers or affiliates, when they have provided or offered you Mediagenix Services Software Solutions or Services, please refer to their Privacy Policy for more information.

We may receive some usage data from third-party service providers and technology partners whose software interact with Mediagenix website or Software Solutions. Unless mandatory under applicable laws, Mediagenix does not process or collect a “special categories of data” such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership and the processing of genetic and biometric data.

4. Accuracy of personal data

We generally rely on personal data provided by you (or your authorized representative). In order to ensure that your personal data is current, complete and accurate, please update us if there are changes to your personal data by informing our Data Protection Officer in writing, using the contact details provided in Article 22 (“Contact Us”) of this Policy.

5. What is the purpose of processing?

We process your personal data for the particular purpose of handling your requests or providing our Software Solutions or services in general. We only process the data necessary for achieving that purpose. More specifically we process personal data for the following purposes:

  • Supply our Software Solutions and Services to customers: In order to provide you with access to our Software Solutions and/or Services we need your first name, surname, email address. This way we can offer our Services, provide support, respond to your inquiries and keep you updated on the status of the ongoing projects. In addition, we may use your information to contact you in order to inform you about our product or Services (e.g. we send you emails about upgrades or service-related announcements);
  • To provide prospects access to our demo environment;
  • Complying with law: Comply with applicable legal requirements, such as tax and other government regulations and industry standards, contracts and law enforcement requests;
  • Enforcement: Enforce our customer contracts and other legal terms or policies;
  • Improvement of our Software Solutions and Services: We are continuously searching to improve our Services. To this effect we may use your personal data to ask you to participate in a customer or market survey, Software Solutions feedback survey… Sometimes third parties carry out those surveys. We may collect data for bug management purposes;
  • Management and improvement website: We also use the data of the visitors to our website to manage and improve these website as well as to analyze the use thereof;
  • Management of customers, suppliers and partner programs: We store the contact details of our business customers and partners to manage the relationship with these customers and partners;
  • Contests: When you participate in an action or contest, we will ask your name, address and email address. This way we can execute the contest and contact and announce the laureate(s). This way we also measure the response to our advertising actions;
  • Direct marketing and public relations: We only provide you with direct marketing communication (e-mail, push notifications, …) when:
    • we or a third party have obtained your consent (e.g. through a checkbox or webform);
    • where we have a commercial and/or contractual relationship (e.g. you are a (trial) customer, you have downloaded one of our documents, …) and Mediagenix has a legitimate interest to provide you related direct marketing communication.   • Images and videos: we may process your image, photos, video footage or recordings in which you appear for marketing, promotional, public relations or corporate communication purposes. This may include the creation, publication and distribution of materials relating to Mediagenix events, webinars, customer testimonials, case studies, interviews, social media posts, website content, brochures or other promotional materials, where permitted by applicable law and, where required, based on your consent;
  • To provide you with Whitepapers and Brochures upon request;
  • Security and fraud monitoring: We may process personal data to examine, prevent and fight fraud and protect our and other’s interests, rights and property. We make use of CCTV in all our offices;
  • Analytics:
    • We may use your personal data for scientific research, market research & statistical research and to generate software solution usage analytics that help us understand how our Software Solutions are used, improve their performance and usability, and provide insights to our customers regarding adoption and efficiency.  
  • Recruitment: we may process personal data of job applicants in relation to our recruitment activities, for the management of job applications (any personal data that you provide through our job application. Within a reasonable period after the procedure, we will delete your personal data, unless we have informed you that we require it for other purposes, or we ask your consent to maintain your data. 6. How do we process your personal data?

We may use artificial intelligence (AI) tools to assist in providing our services, including customer support, content generation, and data analysis. Where these tools process personal data, such processing is carried out in accordance with applicable data protection laws and only for the purposes described in this Privacy Policy.

7. With whom my personal data are shared?

In principle your personal data are only accessible to the authorized personnel within Mediagenix on a need-to-know basis. In any case, those personal data shall only be processed for the purposes described in article 5.

Mediagenix internal staff may be located outside the jurisdiction of the data subject (e.g. in Singapore) and may access personal data stored in the jurisdiction of the data subject for their daily business operations. 

All these members of our personnel are bound by contractual confidentiality terms and strict internal rules and procedures with respect to the processing of personal data. They are also obliged to observe the technical and organizational measures that we have taken to protect your personal data.

In principle we do not share your personal data with anybody outside Mediagenix. Sometimes it is however necessary that for operational reasons we appeal to meticulously selected third parties within the scope of the purposes described in article 5. These recipients can only use the indicated personal data for the execution of their specific task, need to act in respect of our Privacy Policy and they cannot use them for any other purposes.

Within the scope of performance of their tasks, the recipients are also obliged to comply with the provisions of the General Data Protection Regulation and any other applicable data protection and security laws, as well as their contractual obligations, including confidentiality obligations, towards us. Such recipients may be located in jurisdictions outside the European Economic Area that may not guarantee an appropriate level of personal data protection. With respect to the transfer of personal data to such jurisdictions, we shall take proper measures to make sure that the transfer is realized in accordance with the applicable rules relating to the international transfer of personal data.

  • Processors who provide hosting of the Website and related databases;

In addition, certain Software Solutions usage analytics may be shared with your employer or organisation (our customer) in order to provide them with insights into how their users interact with our Software Solutions. Such analytics are provided in aggregated or pseudonymized form wherever possible to minimize privacy impact.

  • Right to erasure (“right to be forgotten”): in certain circumstances, you can ask us to delete your personal data;
  • Right to restrict processing: you can request that we limit how we use your personal data in certain situations;
  • Right to data portability: you can request to receive your personal data in a structured format and transfer if to another service provider;
  • Right to object: you can object to certain uses of your personal data, such a direct marketing, which can be exercised through every newsletter via the “unsubscribe” button;
  • Rights related to automated decision-making: you have the right not to subject to decisions made solely by automated processing if they significantly affect you.

15. Protection of your personal data

We take the necessary administrative, technical and organizational measures to ensure the security and confidentiality of your personal data  and protect your personal data  against destruction, loss, abuse, unlawful granting of unauthorized access, to the transmitted, stored or otherwise processed data, either by accident or unlawfully, which more in particular may lead to physical, material or immaterial damage.

These measures consider the state of technology, the implementation costs, as well as the nature, the size, the context and the processing purposes and also the probability and severity of the various risks for the rights and freedoms of natural persons that are related to the processing.

Your personal data will be retained as long as necessary for achieving the purpose for which they were collected and in line with the legal, regulatory and internal data retention policy in this respect.

Mediagenix website makes use of cookies. Cookies are small text files that are stored on the hard disk of the computer and/or devices of the visitors of certain websites. They contain certain information, such as for example the language preference indicated by the visitor. Other cookies collect statistics about the visitors of our website or make sure that the graphical layout of the website is correctly represented and that the applications of the website operate correctly. 18. Information security policy

Mediagenix’s customer information assets and personal privacy related assets shall be protected from threats identified, whether internal or external, deliberate or accidental, such that:

  • confidentiality of information is maintained (loss of notebook, portable, confidential mail send to unauthorized person);
  • availability of information is arranged;
  • legal, regulatory, statutory and contractual obligations are met; and
  • the brand image is protected.

Mediagenix is committed to continually improving the ISMS to help ensure that its applicable information security objectives are met, and the ISMS is able to adapt to internal/ external changes.

19. Links to other websites

The Mediagenix website may contain links to websites that are administered by companies outside Mediagenix. Those other websites have their own Privacy Policy which you should carefully read when you visit them. In no case whatsoever we shall be held liable for the content of those websites, nor for any processing of personal data by these third parties.

20. Anonymous data

Mediagenix is permitted to collect non-personal and anonymous data and anonymize personal data. This data does not allow Mediagenix to proceed to identify an individual person and this data can be shared with third parties, including for statistical purposes.

This Privacy Policy is subject to modifications. Mediagenix may change this Privacy Policy to reflect changes in the law, our personal data handling practices, or the features of our business or Services. We will make the updated Privacy Policy available on our website and show the date the Privacy Policy was last updated and version, to help you know when we change it.
